Debt recovery

 

 

Our overall fees vary depending on the type of work and stage of the process. We will either work on a fixed fee or hourly rate basis. We’ve highlighted these costs below on a single instruction basis (where you ask us to handle multiple debts, we will adjust our fees accordingly).

We’ll keep you updated as work progresses and the costs you will incur at further stages of the debt recovery process. We’ll never act without your instruction to do so.

Letter before action

Prior to any court claim a pre-action letter will be required. This is a formal demand for payment and will include the balance of the debt outstanding and a demand for repayment with the threat of court action to follow if not repaid.

To prepare this letter we will require the following from you:

  • Name and address of the debtor
  • Amount owed
  • Evidence as to how the debt has arisen and whether interest or other charges have been added
  • Any prior correspondence demanding payment of the debt

We can generally offer a fixed fee of [£XXX] + VAT for this service which includes:

  • Taking your instructions
  • Reviewing documentation provided by you
  • Sending a letter before action

Often an initial demand for payment can result in offers of payment being received. We will charge you on an hourly rate basis to undertake negotiations on your behalf. This will be charged at [£XXX]/hour.

Issue court proceedings

If the debt has not been paid or disputed by the debtor, in which case we’ll provide you with a revised quote following the letter of action, we will draft and issue court proceedings on your behalf. Our fixed fee for issuing court proceedings are listed below exclusive of VAT which will be charged at 20%.

Once the court claim has been issued, the debtor has 14 days to respond and file a Defence. If they file an Acknowledgement of Service, they will have a further 14 days in which to file their Defence.

Enter Judgement

If no acknowledgement of Service or Defence is received, we can apply to the Court to obtain Judgment in Default. This means you have a court order which you can enforce to recover your debt.

When the Judgment in Default is received, we will write to the debtor to demand payment. If payment is not received within the timescales given by us we will advise on next steps such as enforcement action and likely costs. These will be quoted on a case by case basis.

Other Costs

You will need to pay for disbursements and enforcement action costs in addition to our costs listed above. In debt recovery matters the most common disbursements tend to relate to bailiff for enforcement action or Counsel’s fees if litigation is required.

Recovering Fees

Upon conclusion of a successful claim the Court fee can be recovered along with very limited fixed commencement costs (between £50-£100). However, our fees are not recoverable in claims of £10,000 or less, as these matters will be allocated to the small claims track where legal costs are unrecoverable except for in exception circumstances. Please note that interest and compensation may take the debt into a higher banding and the VAT on our legal fees cannot be reclaimed from the debtor.
